    In a move that’s quietly shaping Florida’s cannabis future, Governor Ron DeSantis (R), a 2024 Republican presidential hopeful, has signed a significant bill into law, effective since last month. This legislation expands both the restrictions on medical marijuana advertising and manufacturing and the eligibility criteria for individuals employed within the industry. The new law prohibits the promotion of “recreational” cannabis use through products or messages, while also ensuring they don’t appeal to children. This pivotal step might significantly impact Florida’s cannabis market, especially considering the potential for a future ballot measure on adult-use legalization.

    Under the legislation’s provisions, cannabis manufacturers and retailers are now barred from producing or promoting products with an allure for children or a suggestion of recreational use. This notable shift closes the gap that previously allowed non-medical use promotion, and the previous constraints were limited to infused edibles.

    However, the specific definition of what constitutes promoting recreational use remains undefined in the legislation. This ambiguity could potentially clash with a forthcoming constitutional amendment advocating for adult-use marijuana legalization, currently under discussion for the 2024 ballot. The crux lies in the conflict between legally marketing products intended for adult recreational consumption and the new law’s stipulations, unless the latter undergoes revision or legal challenge.

    Efforts for adult-use legalization in Florida are underway, with the Smart & Safe Florida campaign securing enough signatures for the initiative’s inclusion on the ballot. Nonetheless, State Attorney General Ashley Moody (R) is actively striving to invalidate the initiative in the state Supreme Court. She argues that the initiative’s title and summary are misleading, aiming to clarify that state-level legalization wouldn’t override federal prohibition. Although a previous legalization attempt was rejected, campaigners believe they’ve learned valuable lessons, crafting an initiative with the legal solidity for ballot placement. The court is expected to schedule oral arguments soon.

    Parallelly, Governor DeSantis’s signed bill will likely lead to a reduction in the pool of eligible industry workers. This alteration stems from the removal of exemptions for individuals with certain criminal backgrounds after specific periods. Furthermore, the bill extends background screening obligations to encompass all medical cannabis testing lab employees, not just owners and managers. The responsibility for federal fingerprinting processing fees also shifts from individuals to the medical cannabis businesses.

    Critics worry that these changes could potentially result in a less diverse workforce, disproportionately affecting those historically impacted by the war on drugs. These developments occur amidst DeSantis’s mixed record on cannabis. He has taken measures to support the state’s medical cannabis and hemp sectors while also enacting certain restrictions. For instance, he recently signed legislation barring the sale of consumable hemp products, including cannabis “chewing gum,” to individuals under 21.

    June saw DeSantis signing a bill that rewarded two Black farmers with long-awaited medical marijuana business licenses. However, he also endorsed a measure that prevents sober living facilities from allowing residents to possess or use medical marijuana, irrespective of doctor certifications. The fate of Florida’s cannabis landscape hinges on the ongoing state Supreme Court case, potentially removing DeSantis’s influence over legalization decisions.

    Economic analysts from both the Florida legislature and the Governor’s office predict that an enacted marijuana legalization initiative could yield between $195.6 million and $431.3 million in annual sales tax revenue. These figures could rise significantly if lawmakers opt for an additional excise tax similar to those in other legalized states. As Florida treads this uncertain path, its cannabis industry stands at a true crossroads, where legal, economic, and societal factors converge.
