The Road to Legalization
- So, what’s the deal with marijuana in Ohio these days? Well, as of now, possession and use of cannabis by adults aged 21 and older is completely legal under Ohio state law. It’s a green light, folks! But hold on to your joints; there’s more to the story.
- Ohioans made their voices heard loud and clear when they approved Issue 2 with a 57–42 vote last month. It seemed like smooth sailing until some lawmakers started stirring the pot (pun intended). Initially, the plan was to make some serious changes, like nixing home cultivation, reducing legal possession limits, and raising taxes. The ACLU of Ohio even called it a “demolition of Issue 2.” Talk about a buzzkill.
A Plot Twist from the Senate
- But guess what? The GOP-controlled Senate did a 180 and approved a revised bill, expanding some aspects of the voter-approved law. They’ve given the green light for all adults aged 21 and older to buy cannabis from existing medical dispensaries in as little as 90 days. Home cultivation rights are still intact, and automatic expungements for prior convictions are on the table. Talk about a twist in the tale!

Is Marijuana Legal in Ohio Now?
- Absolutely! Adults aged 21 and older can legally possess up to 2.5 ounces of cannabis and 15 grams of marijuana concentrates. That’s a pretty good stash, wouldn’t you say?
Home Cultivation: Green Thumbs Welcome
- Growing your own marijuana at home is A-OK in Ohio. Issue 2 allows each adult aged 21 and older to grow up to six plants, with a maximum of 12 plants per household. However, there’s a proposal to reduce the household limit to six plants, regardless of how many adults live there. Stay tuned for that.
When Can You Buy Legal Weed?
- Under the Senate-approved bill, you could be lighting up legally in as little as three months! You’ll be able to purchase marijuana from existing medical dispensaries sooner than expected. That’s a win for all you eager beavers.
In the Meantime: Sharing is Caring
- Until the regulated market takes off, sales of marijuana remain illegal. So, you might have to rely on your green thumb or share with friends. Sharing is caring, right? Just remember, noncommercial transfers between adults are limited to 2.5 ounces of flower and 15 grams of concentrate.
DIY Concentrates: A Bit Tricky
- When it comes to making concentrates for personal use, there’s a catch. Hydrocarbon-based extraction methods (like using butane) are a no-go under Issue 2. However, other, safer extraction methods are allowed for now. So, get your hash-making skills ready!

- Now, let’s talk about the future. According to current law, a Division of Cannabis Control will be established under the state Department of Commerce. They’ll be in charge of licensing, regulating, investigating, and penalizing adult-use cannabis operators and more. Clearing the Smoke: Expunging Prior Convictions
- Here’s the million-dollar question: Will past cannabis convictions be expunged? It’s a bit hazy, but there’s hope.
