Maryland Hemp Industry Fights for Fair Play: Lawsuit Takes on Monopoly and Restrictions
In a bold move, a coalition of hemp companies in Maryland has taken legal action against state entities and Governor Wes Moore, asserting that their business opportunities tied to hemp-derived products have been unfairly limited. The Maryland Hemp Coalition, bearing the torch of the Hemp Industry Challenge, has filed a civil suit against Gov. Moore, the Maryland Cannabis Administration, and the Alcohol, Tobacco and Cannabis Commission. The crux of their argument, as reported by the Baltimore Sun, centers around the allegation that the state’s actions have effectively paved the way for licensed marijuana operators to monopolize the industry. This has been achieved through the imposition of caps on THC concentrations in products containing CBD, along with stringent licensing regulations.
Nationwide legalization of products containing delta-8 THC, CBD, and other hemp-derived cannabinoids with less than 0.3% delta-9-tetrahydrocannabinol was solidified by the 2018 Farm Bill. However, the Hemp Industry Challenge has thrown into the spotlight Maryland’s recent laws, which came into effect on July 1 – coinciding with the commencement of adult-use marijuana sales. These new regulations have not only set a limit on THC concentrations, but they have also effectively thrown up roadblocks for hemp operators seeking business licenses.
Nevin Young, a legal representative of the hemp industry, succinctly encapsulated the situation, sharing with The Baltimore Banner that “almost all of the (CBD) products that are presently being sold would fall under the new statute and would require a license to be sold.” The Hemp Industry Challenge contends that these provisions, while ostensibly introduced to align with changing legal landscapes, have cast a shadow over the burgeoning hemp sector and its players.
The lawsuit, filed in Washington County Circuit Court on Tuesday, has ignited a fierce debate. On one hand, proponents of the hemp industry see this as a pivotal moment to champion fair competition and the growth of a promising sector.
